Terms & Conditions

By requesting a product or service from Rock IT Limited you accept our terms
and conditions. These terms and conditions are subject to change at any
time, and it is your responsibility to check our terms and conditions each
time prior to purchasing any service or product from Rock IT Limited.
1. Supply Of Goods
The sale of EasyPay, is carried out through our two resellers, Training
Tailor Made and Mediterranean Computer Services. As such the terms and conditions
of the sale are also subject to your chosen reseller's terms and conditions.
Any goods supplied to the customers remain the property of Rock IT until
such time as they have been paid for in full. In the event of insolvency
or liquidation the customer agrees to allow Rock IT or its agents reasonable
access to such goods in order to facilitate their removal.
2. Data Privacy & Data Loss
In the course of our work, Rock IT and its resellers, may have privileged
access to confidential information. We undertake to safeguard your equipment
and data as far as is reasonably possible. Our policies require us to maintain
the highest standards of confidentiality for our clients. We respect your
privacy; your data is secured and staff policy expressly forbids unauthorised
access to this data. We take all reasonable precautions to prevent the loss
of client data whether working on site or in our offices.
We are conscious that backing up
data is a time consuming task, and when working on site we are less likely
to routinely back up data unless we perceive a real risk of data lost, in
order to keep your charges as low as possible. However when working with
systems that often already have problems it is inevitable that from time
to time data loss will occur. When this happens we undertake to make all
reasonable effort to recover this data using our in-house expertise, and
at out own expense. By accepting our services the customer agrees to indemnify
us from any losses arising from data loss as a result either directly or
indirectly from our work. This clause is not an attempt to avoid responsibility,
but rather an attempt to avoid vexatious litigation - our view is that if
it really was that important then you would have backed it up anyway.
3. Legal Jurisdiction
Contracts between you and Rock IT shall be governed by Gibraltar Law and
you and Rock IT submit to the exclusive jurisdiction of the Gibraltar courts.
5. Software License
Your use of any Rock IT Limited software will also be governed by the terms
of a software licence, and our other products and services may also be governed
by additional terms.
Any other third party products or services described on our site are supplied
by the relevant third party and subject to that third party's terms and
conditions. Even where third party products or services are co-branded by
us, we do not endorse them, warrant the accuracy of third party information
about those products or services, or warrant the quality or suitability
of those products or services for your use.
6. Intellectual
Property
You acknowledge that the copyright and any other intellectual property rights
in the Products and/or Services remain with us or our licensors, and may
not be used by you for any purpose other than your lawful use and in accordance
with the software license.
If a third party successfully claims that that our Products or our Services
infringe that third party's intellectual property rights we shall be entitled
to replace the Products (or the part in question), re-supply the Services
free of charge or, at our discretion, refund to you the price of the Products
(or a proportionate part of the price) or the Services, but we are not accountable
to you in any other way. In particular, we shall not be responsible for
any defects or intellectual property rights claims arising from your customisation
of the Products or Services or your other instructions.
